These Terms explain how SmartFinance may be used and the responsibilities that apply when you access the service.

1. Acceptance of Terms

By accessing or using SmartFinance, you agree to these Terms of Service. If you do not agree, do not use the service.

These Terms form a legally binding agreement between you and SmartFinance.

2. Service Description

SmartFinance provides financial research, market commentary, educational content, portfolio tracking tools, newsletters, alerts, and related informational services.

The service is intended for informational and educational purposes only.

3. No Advice

The content provided by SmartFinance does not constitute financial, investment, tax, legal, or accounting advice.

Nothing on the service is a recommendation to buy, sell, or hold any security, asset, cryptocurrency, or investment product.

Content may reflect public sources, third-party data, independent research, personal understanding, analysis, interpretations, and opinions.

4. User Responsibility and Risk

You are solely responsible for your own research, decisions, and compliance with applicable laws.

Investing involves substantial risk. Past performance does not guarantee future results, and you may lose some or all of your capital.

You should consult qualified professionals before making financial decisions.

5. Public Sources and Third-Party Data

SmartFinance may rely on public sources, market data, news, filings, APIs, and other third-party information.

We do not guarantee that any information is accurate, complete, current, or uninterrupted, and third-party sources may contain errors or delays.

6. Subscription and Payment

Certain features may require a paid subscription. SmartFinance currently offers a Free plan with delayed access and a Premium plan at €10/month or €100/year. Pricing, access levels, and billing terms may change from time to time.

Unless required by law, fees are non-refundable. Failure to maintain payment may result in suspension or termination of access.

Payments are processed solely by Stripe. Stripe is solely responsible for payment processing, security, fraud, disputes, and compliance related to payment data.

Payment information is collected and processed directly by Stripe, and Stripe is solely responsible for keeping payment data secure. SmartFinance does not store full card details.

7. Intellectual Property and Prohibited Use

All content, software, branding, and materials made available through SmartFinance are owned by SmartFinance or its licensors and are protected by applicable intellectual property laws.

You may not reproduce, redistribute, resell, reverse engineer, scrape, or otherwise misuse the service or its content.

8. Disclaimer of Warranties

SmartFinance is provided on an as-is and as-available basis to the maximum extent permitted by law.

We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

9. Limitation of Liability

To the maximum extent permitted by law, SmartFinance is not liable for direct, indirect, incidental, special, consequential, or punitive damages, including lost profits, investment losses, or data loss.

Your sole remedy is to stop using the service.

10. Termination

We may suspend or terminate access to SmartFinance at any time, with or without notice, for any reason.

Termination does not affect rights or obligations that arose before termination.

11. Governing Law

These Terms are governed by the laws of European Union, without regard to conflict-of-law principles.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of SmartFinance after an update becomes effective constitutes acceptance of the revised Terms.
